Our liability, and the liability of our third party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages and excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.

Job advertisements contained on the site are provided by prospective employers and their agents and are not all advertisements are reviewed by us. We accept no responsibility or liability for the content of advertisements.

Information, tools and services provided on the site are intended to assist in the recruitment process for both Candidates and employers/recruiters. Neither we nor our third party suppliers can guarantee their suitability or prospects of success in any particular case.
Governing Law
These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.
Employers and Recruiters
Definitions
‘Customer’ means any person, company, organisation or firm which uses the services of ITarchitectJobs.com;‘Services’ means all recruitment products and services made available by ITarchitectJobs.com
Site Rules
We have rules regarding the content and format of jobs posted on ITarchitectJobs.com. The purpose of the rules is to ensure that users who search the site or ITarchitectJobs.com database get results which are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from ITarchitectJobs.com any advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.
The Rules are:
- No duplicate posting of exactly the same job unless the same job is available in different locations.
- No gratuitous use of keywords in job descriptions or job titles. Gratuitous is defined as deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing the position of the job advertisement in the results listing, or increasing the number of page views.
- Job advertisements placed on ITarchitectJobs.com must be for genuine vacancies only. ITarchitectJobs.com is not, and not to be used for advertising other products or services, either relating to or unrelated to recruitment. These include but are not limited to, affiliate schemes, career management services, CV writing services, multi-level marketing, pyramid selling schemes, franchises, or any other so called 'business opportunity'.
- URLs or email links (live or text only) are not permitted in the body copy of the job description page. Email links are permitted from the 'send an email' link and URL linking is permitted from the 'apply to URL' link.
- The site is only for jobs in the information technology field of architecture. If we view any advertisement as being for a position which we see as not related to information technology architecture, we may, at our discretion and without liability to you, remove that posting.
Illegal Advertisements
Any advertisements which discriminate on grounds of sex, race or disability or appear to discriminate on these grounds are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory or offensive we may, at our discretion, either amend the advertisement or remove it from ITarchitectJobs.com without liability to you. You will indemnify us against any claim that the advertisement infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive.
Responses to Advertisements
You agree to deal in a fair and professional manner with individuals who may respond to an advertisement you have posted and not do anything which may bring ITarchitectJobs.com into disrepute. You will indemnify us from and against any claim brought by an individual against ITarchitectJobs.com arising from your breach of this obligation or any other of these terms and conditions.
We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out any checks and procedures that are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and other skills and characteristics.
Displaying Advertisements
Your sole remedy if we make an error in displaying an advertisement is to provide you with another advertisement. We shall have no liability for failure to display the advertisement caused by circumstances outside of our control. Neither we nor our subcontractors shall be liable in any circumstances for any loss of profit or business.
Content and links
It is your responsibility to maintain any external links that your advertisement may point to. We may remove from ITarchitectJobs.com any advertisement which contains content or links to a site which, in our opinion, is illegal, offensive or objectionable or will bring ITarchitectJobs.com into disrepute. You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements.
Third party sites
Vacancies you post on ITarchitectJobs.com may also appear on third party recruitment web sites pursuant to agreements from time to time between ITarchitectJobs.com and the proprietors of such web sites.
Employment agencies and employment businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act') it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the regulations that are under it. The regulations are in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the use you make of information on our candidate database.
Candidate Database Rights
Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to ITarchitectJobs.com. You acknowledge that you do not acquire any rights in the candidate database or its content and that your use of the database and its content is governed by these terms and conditions.
Passwords
Passwords are for the sole use of the person to whom they are issued. We may deny access to a password if we reasonably believe that it is being used by an unauthorised person or that the user is breaching these terms and conditions.
Use of the Candidate Database
If the package you have from us includes access to the candidate database the following applies:
You can:
- Search the database for the purpose of finding suitable candidates for job vacancies that either you, or your client (if you are an employment agency) wish to fill.
- Use the information about the individuals contained in the database for the purpose of contacting in relation to a specific job vacancy.
- Use the information only in connection with your own recruitment-related activities.
You can not:
- Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.
- Download the database or portion of it through any automated processes, including, but not limited to, “scraping”.
- Contact the individuals on the database or allow any use of the information about those individuals for any reason other than for the purpose of finding suitable candidates for specific job vacancies. You must comply with the Data Protection Act 1998 and all subsequent and related legislation and regulations.
Deleting Database Material
You agree to delete material from the candidate database upon its replacement with up-to-date material or the satisfactory conclusion of your search for a suitable candidate, whichever occurs first.
Dealings with Candidates
You agree to deal fairly and professionally with individuals that you may contact using information from the candidate database, and not do anything which may bring ITarchitectJobs.com into disrepute. You will indemnify ITarchitectJobs.com from and against any claim brought by an individual against ITarchitectJobs.com arising from your breach of this obligation or any other of these terms and conditions.
Refund Policy
If you are unhappy for any reason and believe you are entitled to a refund, please contact us with your full account details and reason for requesting a refund.
Refunds will be given at the discretion of the Company Management.
